Planning Permission Exemption (ExPA)

EXEMPTION FROM PLANNING APPROVAL (ExPA)


​Further to the decision of the Local Central Committee Meeting on 13 September 2017, the Council has agreed to adopt the Exemption From Planning Approval (ExPA) effective on 1 October 2017.​​

  1. Building plan applications for developments that are exempt from planning permission must be submitted by a qualified consultant who is either an architect or a plan draftsman registered with the Malaysian Architects Board (LAM) and has the following roles:​
    • Make a certificate that the application meets the characteristics of ExPA and is responsible for the information provided;​

    • Submit building plans and related documents to PBT for approval;​​

    • Submitting documents and plans as directed by PBT; and​
    • Take responsibility for any problems that arise after implementation.​​
  2. ​Developments exempted from planning permission still need to go through the application process for building plan approval and engineering plan approval. The application must be submitted as a building plan application at the Central Centre​ (OSC) counter with documents such as the applicable building plan approval checklist and engineering plan approval as well as the ExPA Form.

  3. The types of development that can be considered exempt from planning permission are as follows (Please refer to the details on the ExPA Form):​​​​​​​​

    • Establishment, Demolition, Re-Establishment Or ​Change of One Unit of a Residential House.​​

    • Erection, Demolition, Re-erection Or Alteration Of One Light Industrial Building Unit.​

    • Erection, Demolition, Re-erection Or Alteration Of A Common Property Building In The Strata Housing Area.

    • Alterations To Upgrade And Repair Buildings.​​​

    • ​Establishment, Demolition, Re-erection or Alteration of a Utility Building.​​​​

​​4. In processing a building plan application subject to ExPA, the applicant needs to fill out the ExPA Form and submit the application to the OSC who will refer to the Planning Department to obtain confirmation that the building plan submitted has complied with the ExPA characteristics.
